stand a chance. she is a super star. >> in hollywood, anita, fox news. >> thanks so much for joining us tonight at 10:00. here's brian with the news edge at 11:00. >>gas prices already high and some local drivers may be asked to pay even more. take a welcome at the recent changes. the prices went up 4 cents a gel gallon in d.c. one price hasn't changed. it's been twenty years since maryland raised the state gas tax and montgomery county is in dire need of transportation funding. the condition council met with business leaders today, one of the hot topics, a possible county wide gas tax. lauren demarco has that story. >> when i pulled up and i saw $4.09, oh my goodness. >> steadily increasing for the last seven weeks. it's unlikely maryland legislators would agree to an increase on the state's gas

tax. the president of the montgomery county council wants to take the matter into his own hands. >> if the state does not have the political will to do this, i'm saying local governments, like montgomery county, has to be able to move forward on their own. >> roger wants the state to give county lawmakers the authority to raise g taxes. the county would retain 100% of the revenue. with funding going toward road improvement projects and public transportation like the purple line and the corridor city's transit way, a proposed rapid bus line between shady grove and clarksburg. >> many communities don't share the priorities. they don't have the transit needs we have. they have needs for major funding. >> the league says she is concerned the plan could set a dangerous precedent. >> don't we and montgomery county pay taxes that benefit the people in garrett county and prince georges county and so forth? for every dollar we sent to

annapolis, we get 18 cents back. are we now going to say in addition to that? tax the citizens of montgomery county for transportation? no. i don't think so. >> the state already has a 23.5-cent per gallon gas tax included in the price we see at the pump. how much of an increase would we be talking about? >> most people talking about a statewide gas tax, we're talking about between 5 cents and 10 cents. >> the reaction among drivers was mixed. >> i would certainly support it. if it would help improve the transportation. >> i think that just keep raising rates right now and so many people are struggling to get by is not always the answer. we can't keep taxing people. >> now the earliest we would see any action on this would be january. he hopes to meet with the governor and state legislatures to discuss what can be done in time for the next session of the general assembly. brian, over to you. prosecutors will not seek the death penalty in a montgomery county murder case.

that decision revealed today during a pretrial hearing. heats accused of killing his estranged wife and beating her son with a baseball bat. the body was later found in the woods. lopez tried to get evidence from a medical expert suppressed. the judge says he will allow that testimony. jerry sandusky will likely die in prison. the former penn state assistant coach sentenced today to a minimum of 30 years in prison. he was convicted of sexual aabusing 10 boys. some victims testified. described how his abuse changed their lives. sandusky addressed the court and denied any wrong doing. >> jerry never flinched from his position that he was innocent and that he wanted the opportunity to prove his innocence. >> completely untethered from reality. without any acceptance of responsibility, it was tirely self-focused as if he again were the victim.

it was ridiculous. >> sandusky's lawyers say they plan to appeal. meantime, some of sandusky's victims are suing penn state with how the university responded. >> monitoring metro tonight in the latest crime numbers, serious crimes have gone up in the last year. they include aggravated assault, thefts, and robberies. up almost 7%. the largest jump, robberies. thefts of iphones and other electronics. metro transit police reported the ten most dangerous stations in the system. you can see that list on the screen. seven of the top ten most dangerous are in d.c. the other three in maryland. the election still weeks away, but metro planning for innog ininauguration. looking at video of the crowded metro stations during the 2009 inauguration. peek services extend all day. metro also issuing a special commemorative smart trip card

virginia by 235,000 votes. the first lady says that is as little as 100 votes per presixty. >> that precinct. >> a single vote in an apartment building. >> at this rally in loudoun county, there were four people who spoke before michelle obama and they were all women. you can bet that's no accident. >> the very first bill he signed into law as president was to make sure women get equal pay for equal work. >> lisa and her little daughter will be following the first lady's instructions by encouraging others to vote. >> we go to a reading group, all women, great time to talk to women about the issues of being a mom and how barack obama is pushing womens issues. >> there are so many signs that we are headed in the right direction. the stock market has doubled. housing prices are rising. the unemplis the lowest it's been since my husband took office. >> the first lady told these virginia voters, you are the

key. >> we need you to work like you've never worked before. >> the voter registration deadline in virginia is this monday, october 15. the election is now just 28 days away. >> love you all so much. >> in loudoun county, virginia, beth parker, fox 5 news. >> republican nominee, mitt romney, bolstered by new polls to show him closing the gap is focusing his attention on ohio. romney appeared at a rally this evening. he was joined by chris cristie. romney plans to campaign in ohio during four of the next five days. another big story we are following tonight, a cancer patient taking what she calls an end of life vacation. she was humiliated in an airport security line. case is getting national attention. led to a tsa investigation. will thomas joins us with more. >> reporter: hi brian,my shed denai is terminally ill, but

wanted to go to hawaii. what started as an embarrassment. she received a full patdown at sea-tac airport in washington and was asked to lift her shirt and pull back her bandages so agents could see her feeding tubes. the happened in the middle of the airport. she asked for a private screening room, but she was turned down. she claims agents opened her sterile medication contaminating some of the fluids that she needs to survive. she called the airport ahead of time and thought she was prepared for the screening. now she wants to make sure other special needs passengers don't have to go through the exact same experience. >> when somebody wants to take a trip, especially what i call an end of life trip, because you want to see your family and friends, then it becomes -- it is more important than just taking a trip. >> the tsa says it is investigating. let's bring in kate. she is the executive director of fliers rights.org. thanks for skypeing with us, kate. >> thanks for having me.

>> you bet. >> assuming the claims from this dying woman are true, it sounds like this patdown was not done in a dignified manner. aren't we all entitled to that? >> we are. and in fact, tsa should have offered her a private room and they should have offered her the opportunity to explain how her medical devices work so that they didn't have to ruin them. >> so, you are allowed to ask for a private screening and get one, because sometimes they do want to look under your clothes and there's a privacy issue. my second part to that question is, are you allowed to have a witness present? >> absolutely. they are supposed to offer you a private room and offer that you can have a witness present. if you don't have someone with you, you can ask for someone else in the line to come in and witness it. it is undignified, but better than standing out in the open room. >> kate, if you are traveling with medications, a unique medical condition, what can you do to ease the security check point experience? >> bring a doctor's note, bring a card that has anything

a young woman ice night on the town turned deadly after she drank a cocktail filled with liquid nitrogen. debbie was enjoying a night out with friends. she began to complain of severe stomach pains. she was taken to the hospital where she was diagnosed with a perpherated stomach. >> she'll have to eat smaller meals more frequently. perhaps nutritional supplements, but she should be able to live a relatively normal life. >> some bartenders usually

they are all the result of the tainted steroid product sent to medical facilities in christian burling. as a result, those facilities have contacted more than 630 patients about possible exposure. number two, watch the type of fish you eat when you are pregnant. a new study found low levels of mercury can increase the chances of adhd symptoms. moms to be who ate more fish had children with fewer signs of adhd. doctors say eat fish, but make sure it is low in mercury. and number one tonight, facebook's like button has some competition. the social network is testing out a want button. it allows users to create wish lists of products they would like to buy. those lists will be shown on a user's time line. pottery barn and victoria's secret are participating. and brian, that's tonight's fox 5 top 5. >> maybe today was the turning point for the week. >> i think it is. we are going to have cool days,

brian. a little bit up and down. it's mostly a great trend we are on and going to be a lot brighter than it has been the past couple of days. tonight, we have the clouds hanging tough. don't be shocked if you get drizzle on the windshield if you are driving later tonight. and maybe a few patches of fog here and there, but all things considered, we are mostly done with the rain for a while and the next number of days are going to be fairly quiet. let's start out with the big news for tomorrow. many of you may be headed out to nationals park to watch game three and the forecast looks fantastic. absolutely does. we're going to start out with clouds, but by the time the game gets rolling, more sun than clouds. temperatures in the upper 60s. late inning, might feature a breeze out of the west at 10, 15, or 20 miles an hour. but that will be with the frontal boundary coming through and that front looks like it's going to come through dry. we'll top out around 70 degrees. one degree below what is average. hard to believe we are already

into the middle of october. it will feel more october-like to you on thursday. the front that comes through tomorrow is going to drop our temperature on thursday down to about 62. we'll describe that as cool. but a little bit of a rebound on friday, up to 67 degrees and saturday's temperature about 65. heading into the weekend, looks like things are going to be staying dry and a warmer day for you on sunday. meanwhile, we focus locally right now, we are still at 59 degrees. not bad. the temperature has not fallen dramatically. a lot of cloud cover around and socked in tonight. those clouds acting like a little bit of a blanket. it is 49 in martinsburg. 46 in winchester. your skies may clear fairly early, you could have fog more than the rest of us, locally, and 95. the clouds are going to hang tough overnight and into the morning hours. you know the temperature is 59 degrees. wanted you to see there's a push of cool air coming behind

our boundary. chicago is 43. the front is just coming through there right now. st. louis 61. and then you get on oater side of that front and it's mostly in the mid 30s to near 40 and a will lot of showers. is this going to produce showers for us tomorrow afternoon and rain delay? that does not look likely at all. all of this moisture is going to scoop up to our north and the clouds here and there are going to get a kick out of town by late morning to the noon hour. frontal boundary will swing through in the afternoon. we think it comes through dry with most of the showers up to our north. you will notice breeze, maybe a small deck of clouds coming through at 5:00, 6:00, and we are back to more sunshine on thursday with high pressure in control. it will be a cool day, certainly nice, bright, and sunny day coming. quick look at your future cast. you can see the pattern with the clouds and showers. especially areas east. a few hanging around in the morning, perhaps skies are

beginning to brighten. but again, it shown for the past couple of nights and doesn't quite happen. going through the afternoon, it definitely gets nice and bright. you can see wednesday at 2:00, here comes the frontal boundary. notice how the showers disappear as they come through d.c. and it's going to be full steam ahead. here's your fox 5 seven-day forecast. again, warm tomorrow at 70. it will take a while to get there and cooler days, but sunny days thursday, friday, and saturday. we get into sunday, we are still dry heading into the weekend. temperatures warm up to 73 degrees. we stay in the 70s monday and tuesday. so it's a good looking forecast and scott smith has more on our big game three tomorrow. here's his report. >> this is the verison sports desk with scott smith. >> the fans playoff baseball is a completely different animal. everything changes. the players, it's still baseball. very little changes. both can agrow on the

magnitude. the first meaningful matchup here in d.c. in october since fdr was president. edwin jackson, making his first start since picking up his first win in the season. finale against the phillies. his last outing against st. louis was forgettable. lasting two innings, allowing nine runs. but jackson has experienced in the post season and he'll look to put that to use against his former team tomorrow at 1:00. >> he pitched a ton in the post season. i think throughout the whole regular season, our staff is relatively young. for him to be able to talk to them, give them advice day in and day out on how to be ready every fifth day has helped them throughout the regular season. for them to have that experience and go out there and a pivotal game in in the series is going to be big for us. >> he pitched big games, to have some post season experience helps and you know, he's not going to be in awe of

welcome back. robert griffin, iii, has been cleared to play with doctorrings. he will continue to be monitored throughout the week in case symptoms reemerge. there was some movement on the roster today as well. the skins released billy after booting a league where it's 58% in field goals. they found a guy who never attempted a regular season field goal. kai, two years removed from ucla. he spent time with the cowboys and the bucs. now if griffin experiences any setbacks this week or as shanahan doesn't decide to start him, curt cousins will get the nod.
